General Terms and Conditions

§ 1 Contracting parties

These General Terms and Conditions apply to rental contracts for holiday homes between Landlady: Jessica Payne, St. Josefsstr. 46, 9551 Bodensdorf, Austria, Tel.: +43 (0) 664 123 74 76, info@zweiteheimat.at (hereinafter „Landlord“) and the respective tenant (hereinafter „Guest“).

§ 2 Booking and conclusion of contract

All bookings are processed via Holidu (Holidu GmbH, Nymphenburger Str. 86, 80636 Munich). The rental contract is concluded upon confirmation by Holidu.

§ 3 Rental property

The holiday homes „Almrausch“ and „Steinrose“ in 9551 Bodensdorf/Steindorf on Lake Ossiach are available to rent, each for up to 6 people (118 m², 3 bedrooms, 2 bathrooms).

§ 4 Arrival and departure

Check-in: 15:00-23:00. Check-out: until 10:00 am. Access via self check-in.

§ 5 Prices and payment

Payment exclusively via Holidu. No separate deposit - damage covered by Holidu Protect.

§ 6 Cancellation conditions

The Holidu guideline applies „Strict“:

  • Cancellation ≥ 30 days before check-in: 100 % refund
  • Cancellation 8-29 days: 50 % refund
  • Cancellation < 7 days or no-show: no refund

The tenant reserves the right to prove that no or less damage has occurred. Travel cancellation insurance is recommended.

§ 7 Occupancy and house rules

Max. 6 persons. Binding rules: No smoking; pets by arrangement (max. 1); no events; night-time quiet 22:00-07:00, midday quiet 12:00-14:00; rubbish separation; careful handling.

§ 8 Liability of the guest

Liability for culpably caused damage. Immediate obligation to report.

§ 9 Liability of the landlord

No liability for force majeure. Liability for slight negligence is excluded to the extent permitted by law.

§ 10 Right of cancellation

According to § 18 para. 1 no. 10 FAGG, there is no right of cancellation for holiday accommodation for certain periods. Guest agrees to exclusion.

§ 11 Law and place of jurisdiction

Austrian law. Place of jurisdiction at the registered office of the Lessor; statutory place of jurisdiction for consumers.

§ Section 12 Online dispute resolution

EU platform: https://ec.europa.eu/consumers/odr. No participation in arbitration proceedings.

§ 13 Severability clause

Invalid provisions shall not affect the validity of the remaining provisions.
